Right of Withdrawal
Information about the statutory right of withdrawal for distance contracts concerning goods.

14-day right of withdrawal
Consumers generally have the statutory right to withdraw from a distance contract for goods within 14 days without giving any reason, unless a statutory exception applies.
To meet the deadline, it is sufficient for the declaration exercising the right of withdrawal to be sent before the withdrawal period expires.
When does the period begin?
For a standard order of goods, the withdrawal period generally begins when the consumer, or a third party designated by the consumer who is not the carrier, has received the goods.
Where several goods from one order are delivered separately, the period generally begins when the final item is received.
Where goods are delivered in several partial shipments or pieces, receipt of the final partial shipment or final piece is generally decisive.
How do I withdraw?
The consumer must inform RANDM TORNADO TECHNOLOGY by an unequivocal statement that they wish to withdraw from the contract.
No reason is required.

The model withdrawal form provided below may be used, but its use is not required.
Effects of withdrawal
In the event of a valid withdrawal, we reimburse payments received in accordance with the applicable statutory provisions.
This generally also includes the cost of the least expensive standard delivery method offered by us.
Additional costs resulting from the customer choosing a delivery method other than the least expensive standard delivery offered by us generally do not have to be reimbursed.
Reimbursement is generally made no later than 14 days from the day on which we receive the withdrawal declaration.
Where permitted by law, we may withhold reimbursement until we have received the goods back or the customer has provided proof that the goods have been sent back.
Returning the goods
After exercising the right of withdrawal, the goods must generally be returned without undue delay and no later than 14 days.
The deadline is met if the goods are sent before the end of this 14-day period.

Who pays the return costs?
Customer
For a return resulting from withdrawal, the consumer bears the direct cost of returning the goods.
This applies to the normal return of goods following the exercise of the statutory right of withdrawal.
For a justified complaint concerning a defect, the statutory rules on subsequent performance apply separately.

The consumer is liable for any loss in value of the goods only where that loss results from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
When can the right of withdrawal be excluded?
The right of withdrawal does not exist, or may cease to apply, where the requirements of a statutory exception are actually met.
This may include certain sealed goods which are not suitable for return for reasons of health protection or hygiene where the seal has been removed after delivery.

Merely opening packaging does not automatically result in the loss of the statutory right of withdrawal for every product.
Withdrawal and rights relating to defects are different
The statutory right of withdrawal must be distinguished from the statutory rights relating to defects.
If a product is damaged, delivered incorrectly or defective, statutory claims may exist independently of the right of withdrawal.
