Scope of these Terms
These Terms & Conditions apply to contracts concluded through the RandMTornado.com online shop between us and our customers.
Mandatory statutory consumer protection provisions also apply to consumers.
A consumer is any natural person who enters into a legal transaction predominantly for purposes that cannot be attributed to their commercial or independent professional activity.

Sales to adults only
Products that may not be supplied to minors under applicable youth-protection rules are sold exclusively to adults.
Under German law, the prohibition on supplying and shipping electronic cigarettes and corresponding containers to children and adolescents also applies where the product contains no nicotine.
By placing an order, the customer confirms, where required for the relevant product, that they are at least 18 years old.
We reserve the right to use appropriate age-verification measures and not to fulfil an order where the required age cannot be sufficiently verified.
Product presentation and ordering
The presentation of products in the online shop enables the customer to select the desired products and place an order.
Before submitting an order, the customer can review and, where technically available, correct the information shown in the cart and checkout.
The product information, quantities, prices, shipping costs and other order information shown immediately before the order is submitted are decisive.
Formation of the contract
By submitting an order that creates a payment obligation, the customer makes a binding offer to conclude a purchase contract for the goods listed at checkout.
An automatically generated acknowledgement initially only confirms receipt of the order.
The contract is concluded when we accept the offer. Acceptance may take place in particular through an express order confirmation or shipping confirmation.
Where a payment method offered at checkout results in a different time of contract formation, the information displayed there applies.
Prices and shipping costs
The prices applicable to an order are displayed in the online shop or no later than at checkout.
Additional shipping costs and, where applicable, other order-related costs are shown to the customer before the order is submitted.
The total amount displayed at checkout before the order is submitted is decisive.
For cross-border deliveries, additional duties, taxes or import costs may arise depending on the delivery country where these are not already taken into account at checkout.
Payment terms
The payment methods currently available are shown to the customer during the ordering process.
There is no entitlement to the permanent availability of any particular payment method.
Where special terms of a payment service provider apply to a payment method, they are shown in connection with that payment method or provided by the payment service provider.
Delivery
Available delivery countries, delivery restrictions, shipping costs and, where required, information about estimated delivery times are displayed in the shop or no later than during the ordering process.
Delivery is made to the delivery address provided by the customer during the ordering process.
The customer is responsible for providing complete and correct address information.
If we cannot deliver an order to the selected country or recipient for legal, regulatory or age-related reasons, we may refuse to accept or fulfil the order.
Retention of title
The delivered goods remain our property until the applicable purchase price has been paid in full, insofar as this is permitted under applicable law.
Right of withdrawal
Consumers generally have a statutory right of withdrawal for distance contracts unless a statutory exception applies.

The withdrawal information forms part of the consumer information and is provided separately from these Terms & Conditions.
Statutory rights relating to defects
The statutory provisions governing rights relating to defects apply to goods.
Where goods are defective, the customer has the statutory rights provided by the applicable law.
A manufacturer's guarantee exists only where it is expressly stated as such for the relevant product.
Liability
We are liable in accordance with statutory provisions for damage resulting from injury to life, body or health and in cases of intent or gross negligence.
Mandatory statutory liability provisions also remain unaffected.
To the extent permitted by law, liability in all other respects is governed by the applicable statutory provisions.
Applicable law
To the extent that a choice of law is permitted, German law applies.
For consumers, however, this choice of law applies only to the extent that it does not deprive the consumer of the protection granted by mandatory provisions of the law of the country in which the consumer has their habitual residence.
Consumer dispute resolution
We are currently not willing to participate voluntarily in dispute-resolution proceedings before a consumer arbitration body.
Any statutory obligation to participate remains unaffected.
Amendments and final provisions
An order is generally governed by the version of these Terms & Conditions made available to the customer at the time of the order.
Mandatory statutory rights of consumers remain unaffected.
If any provision of these Terms & Conditions is or becomes wholly or partly invalid, the remaining provisions remain unaffected to the extent permitted by law.
